Links to Other’s Website May Constitute Copyright Infringement

The Banciao District Prosecutors Office in Taiwan has announced that after Easy Way Group (Easy Way) expressed its goodwill and the consultation aided by the Conciliation Commission of Banciao County Office, Sanlih E-Television (Sanlih) has agreed to give assent to the reconciliation and withdraw the copyright infringement lawsuit previously filed against Easy Way and its representative.

 

In 2009, the website of the famous franchise dessert stores “Meet Fresh” owned by Easy Way posted a link to the news video (recorded in 2008) of Meet Fresh made by Sanlih’s news channel.

 

The Banciao District Prosecutors Office noted that even though the said link provided by the website of “Meet Fresh” merely supplied a link for viewing the said video without downloading the data of the said video, because such action was conducted during the validity period of Sanlih’s copyright of the said video, and the use of the said video by “Meet Fresh” was neither authorized nor agreed by Sanlih, such action still breached Copyright Act. Therefore, Sanlih filed a copyright infringement lawsuit against Easy Way and its representative. But the two parties eventually reached reconciliation after Easy Way expressed its goodwill.

 

It should be noted that for companies which intend to utilize media information to gain fame and credibility, the said case should be noted for proper use of such information.
